The Rosenthal Fair Debt Collection Practices Act
California has a law (the Rosenthal Act) that controls how debt collectors are allowed to behave. It applies to almost every kind of collector, including, in many cases, the company you originally owed.
What it covers
- Calls after you've sent them a written letter telling them to stop.
- Calls to your job or your family about your debt.
- Lies about how much you owe, whether the debt is still active, or what can legally happen if you don't pay.
- Threats of action they can't actually take, or don't really plan to.
