Robocalls and unwanted texts
The Telephone Consumer Protection Act (TCPA)
There's a federal law against robocalls and unwanted text messages. It's called the TCPA. It applies all over the country; we represent Californians under it.
What it covers
Calls and texts to your cell phone that use an automated calling system or a recorded voice without your permission. Calls to numbers on the National Do-Not-Call list. Calls from debt collectors trying to reach someone other than the person they reached.
What it pays
$500 for every call or text. If the company knew they shouldn't be calling, courts can triple it to $1,500. There's no cap on how many calls count, and many of our cases involve dozens or hundreds.
What we'll need to know
- How many calls or texts, over what period.
- Whether you ever gave permission to be contacted (and when you took it back, if you did).
- Whether the calls felt automated: recorded voice, robotic cadence, instant text replies.
- Whether your number is on the National Do-Not-Call list.
